On Feb. 3, 1800 Pinckney presented the resolution that "neither the chief justice nor any judge of the United States shall hold office under the government of the United States or the individual states during his continuance in office as a judge of the United States and that an acceptance of such office shall vacate the appointment of any judge accepting the same." 1 This was brought about by Adams' appointment of Chief Justice Jay as envoy extraordinary to France In support of it he made a powerful speech but on a full vote it was lost by two votes.
