DMR 8/19/71 Drop Counts Against 190 At Iowa City By Larry Eckholt (Register Staff Writer) IOWA CITY, IA. - Charges of disorderly conduct against 190 persons arrested during student unrest on the University of Iowa campus in May, 1970, have been formally dismissed, and bond money is being returned to them, clerks of Police Court here said Wednesday. The charges, pending for 15 months during efforts to try the defendants at one mass trial, were dismissed by Police Judge Joseph Thornton upon recommendation of City Atty. Jay Honohan. In a petition filed last week before he left on vacation, Honohan indicated that he did not think the 190 defendants would be found guilty, basing his opinion on a ruling handed down by Thornton earlier this year. 19 Found Innocent At that time, Thornton found 19 defendants innocent of charges of disorderly conduct because evidence presented by prosecuting attorneys failed to show that the defendants had engaged in offensive or violent activities. The arrests took place during student reaction to the U.S. invasion of Cambodia and the Kent State University killings of four students in May, 1970. In the early morning hours of May 8, police ordered protestors to clear the U of I Pentacrest after a night of unrest during which Old Capitol was broken into. When police began arresting people, a group of about 200 persons sat on the steps of Old Capitol. Arrests were made without resistance. "This court is unable to equate such activity as being 'offensive,'" Thornton wrote when he found the first 19 innocent. After those arrested pleaded to the charges, the cases remained dormant for more than six months. Honohan then announced that a single mass trial would be held for 210 persons charged with disorderly conduct - all to be tried under the same set of evidence. The trial was scheduled for Jan. 4, but the cases were continued because of a blizzard. The mass trial was stalled for another six months after Thornton ruled that the 19 were innocent of the charge. Some Addresses Unknown Police Court clerks said Wednesday that checks for the bond money - in most cases for $100 - are being sent to the individuals at their last "known" addresses. Some checks are being withheld because addresses are not known, the clerk said. Defendants who have not left forwarding addresses should notify the clerk's office, they said. Much of the bond money was raised by fund drives after the mass arrests took place. Following are the names of those who had charges of disorderly conduct dismissed against them stemming from student unrest here in May 1970.
