Farm Operation Moving Expense Payments: The owner of a farm operation who is displaced for highway purposes and is in occupancy at the start of negotiations is eligible for a payment for actual, reasonable expenses to include; 1. Actual, reasonable expenses as a result of moving his farm operation or other personal property; and 2. Actual or direct losses of tangible personal property as a result of moving his farm operation; and actual, reasonable expenses in search for a replacement location. Discontinued Farm Operation: Any person who is displaced from his farm operation may elect to receive a fixed payment in lieu of actual, reasonable expenses in moving his farm operation. Such payment shall be equal to the average net earnings of the farm operation based upon copies of his income tax returns during the two taxable years preceding the relocation of the farm operation; or during such other period determined to be more equitable for establishing such earnings. Such payment shall not be less than $2,500 nor more than $10,000. In the case of a farm operation, no such payment shall be made unless the State of Iowa is satisfied that the farm operation (1) has been discontinued or relocated his entire farm operation at the present location; and (2) if a partial taking, the remaining property after acquisition is no longer considered an economic unit as determined by the appraisers.
