HILLVIEW VILLAGE LOW-RENT HOUSING AGENCY OF FORT MADISON, IOWA November 30, 1977 TERRY VAN AKEN, EXECUTIVE DIRECTOR 1102 FORTY-EIGHTH STREET FORT MADISON, IOWA 52627 PHONE 378-6023[?] Chairman PHIL MOORE Vice Chairman GUADALUPE MENDEZ Commissioners THEA KUHLMEIER ISAAC MARSHALL STANLEY SHEPHERD It is my intention to represent the Fort Madison Housing Authority in the best possible under all circumstances. I feel it is my duty to execute the policies as established by the Board of Commissioners. One of these duties, in my opinion and interpretation of policy, is to deal with violations of leases including evictions. The most recent incident concerning Homer Brooks comes ar a time when the Board of Commissioners is weak, being represented by one new board member and lacking one member. However incidences of this sort can't always wait. I truly believe that this particular action represents the only action possible and that no compromise would be acceptable on this issue. A set of standards must be maintained to protect not only the health and safety of all tenants nut also their pride. Thus if one incident as major as this is allowed to happen without being properly dealt with, then the door is left open to promote additional occurrences in the future. I believe tat having to evict someone is the toughest part of my job, especially knowing that you will have to go through a formal hearing to eventually accomplish it. By doing this other tenants may have to become involved. As it now stands Mr. Brooks has a hearing (Magistrate Court) on Friday where he must plead guilty or innocent to the following charges" 1. preach of peace 2. resisting arrest 3. public intoxication These charges were brought against Mr. Brooks by the Police. However, if Mr. Brooks pleads not guilty a court date will be set and tenants witnessing the incident and Emily Kelly and myself may be requested to appear as witnesses. This court appearance will be extremely difficult for some tenants as they are terrified of Homer Brooks already.
