I. UNIVERSITY PRACTICES AND POLICIES AS THEY RELATE TO SOLICITATION The University policy relating to student solicitation is found in the Code of Student Life. We are concerned that current restrictions placed on certain types of "solicitation" by students are unnecessary and may not be best designed to promote reasonable exchanges of ideas by members of the University community. Our specific recommendations carry with them no finding that the current policy is constitutionally infirm. Rather it is our view that the academic community is best served by regulations designed more effectively to promote student expression without disruption of University activities or infringement on the rights of others. Solicitation by recognized student organizations is governed by provisions entitled "Solicitation on Campus" appearing at page 4 of the Code of Student Life. According to this provision, solicitation means, "The seeking of funds or other support, such as signatures, food, or supplies, by recognized student organizations from persons outside its membership. Thus, solicitation could include, for example, such activities as the sale of goods or services, the distribution of literature, materials or products, or the sponsoring of rallies, parades, or similar events. Such solicitation, when conducted by recognized student organizations, is authorized, subject to a series of limitations. First, advance notice of the solicitation is required, and permission must be obtained. Permission will be granted contingent only upon considerations of time, place and manner of solicitation. Second, as a general rule, solicitation is to take place in the Landmark lobby of the Union or, if necessary, in a few other designated places throughout the University. Section 50.043 of the University Operations Manual contains similar, although not perfectly consistent, provisions. Analyzing these provisions in terms of our judgment concerning sound University policy, we make the following comments and recommendations: 1. A prior notification system, as contained in the existing regulation, is not only lawful but sound.
