complaint will be the sole basis for the Committee determination whether to review a case. THE DECISION TO REVIEW IS STRICTLY A COMMITTEE DETERMINATION WHICH WILL BE MADE BY REVIEW OF THE COMPLAINT. DECISION NOT TO REVIEW MAY NOT BE CHALLENGED. V. Fact Gathering Should the Committee elect to review a complaint, a docket number shall be assigned to the complaint. The complainant's name shall not appear on either copies of the complaint or any other document submitted to the entire committee (see paragraph below). All references to the complaint will be made to the docket number in order to maintain confidentiality and Committee objectively. The Committee Chair, where appropriate and in the Chair's sole discretion, may elect to appoint a subcommittee to conduct further factfinding. As a necessary incident to additional investigation, the subcommittee will be apprised of the identities of the parties involved in the complaint to permit subcommittee questioning of persons involved or affected by the alleged deprivation or discrimination. The subcommittee shall consult with the complainant about the complaint and request for relief. In its discretion, the subcommittee may solicit information or consult with any other member of the University community concerning the complaint. In any such consultation, subcommittee members will not reveal the identity of the parties involved. The subcommittee also has the authority to schedule a hearing review by the entire Committee where interested parties may give an oral presentation of the facts surrounding the alleged acts or actions of discrimination. VI. Subcommittee Recommendations and Committee Disposition Upon the completion of its review, the subcommittee will report to the Committee and recommend a course or courses of action for the Committee to consider in accepting to resolve the complaint. The Committee shall discuss the subcommittee recommendation(s) and vote to determine a course of complaint resolution. ALL COMMITTEE DELIBERATIONS AND DISCUSSIONS WILL BE CLOSED TO NON-COMMITTEE MEMBERS. Where a subcommittee is not appointed, the Committee will review the complaint. The Committee may request specific parties to appear before it to respond to member questions. Upon review of the evidence presented, the Committee will vote to determine a course of complaint resolution. If the complaint involves a question between individual parties or groups, the Committee's disposition will be a final resolution of the matter. Committee decisions or recommendations involving individual complaints will not be made public. If the complaint involves an issue of policy (university wide or specific area within the university), the Committee shall file a report if its investigation with the appropriate policy decision maker. The Committee will also have the discretion to recommend a course of possible resolution to the appropriate policy decision maker. Committee decisions and recommendations to policy decision makers may be made public.
