17 1 TITLE IV - DESEGREGATION OF PUBLIC 2 EDUCATION 3 DEFINITIONS 4 SEC. 401. As used in this title- 5 (a) "Commissioner" means the Commissioner of Edu- 6 cation. 7 (b) "Desegregation" means the assignment of students 8 to public schools and within such schools without regard to 9 their race, color, religion, or national origin, but "desegrega- 10 tion" shall not mean the assignment of students to public 11 schools in order to overcome racial imbalance. 12 (c) "Public school" means any elementary or secondary 13 educational institution, and "public college" means any insti- 14 tution of higher education or any technical or vocational 15 school above the secondary school level, provided that such 16 public school or public college is operated by a State, subdi- 17 vision of a State, or governmental agency within a State, 18 or operated wholly or predominantly from or through the 19 use of governmental funds or property, or funds or property 20 derived from a governmental source.
