All were charged with violating university and Board of Regents rules in a campus sit-in held on Dec. 9, 1970. SDS was under probation at the time for activities in a disruptive sit-in a year earlier at the same office. From evidence presented in a hearing Feb. 4 and 5, the former Iowa Supreme Court Justice made his recommendations to university Pres. Willard Boyd, who will review the findings and recommendations before determining the sanctions to be applied. Boyd's ruling may be appealed to the State Board of Regents. The sit-in, which gave rise to the charges against eight students and two former students, occurred Dec. 9 at the Union Career Counseling and Placement Office following a rally sponsored by SDS. As a result of the demonstration, a recruiter from the Defense Intelligence Agency cancelled interviews he had planned for that afternoon, Judge Garfield found. The sanctions that Garfield recommended for the defendants who were students at the time are: • Immediate one-year suspension followed by one year probation: Bruce Johnson, who was under suspension at the time for violation of rules in a similar sit-in one year earlier; • Probation until the end of the 1971-72 academic year: Norton Wheeler, A4E, and Stephen R. Carl, A3; • Probation to the end of the first semester of the 1971-72 academic year: Kirk A. Alexander, A2; Patric Den Hartog, A3; Patricia Farrell, A2; Richard Phillips, A1; and John Tinker, A2. Garfield further recommended that any who violate the probationary status be suspended from the university for one year following. The former students who were not enrolled at the time of the sit-in are Gary Roemig and Roland Schembari, who were charged with violating regents' rules provide that a person found guilty of violation may be denied admission to or employment at any regent institution. Garfield said, however, that he felt that if such a denial should occur, it should not be for as long as one year in the case of the two.
